Terms of Service

These Terms govern your use of the FuelSense iOS app and the fuelsense.au website (together, the Service), provided by Wyse Holdings Pty Ltd (ACN to be confirmed) trading as FuelSense ("we", "us", "our"). By downloading, installing, or using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

FuelSense displays fuel and EV-charger prices, locations, and related information across Australia. Prices are sourced from a mix of: (a) publicly available state-government feeds; (b) data shared by partner stations; and (c) reports submitted by other users of the Service. Some features ("Pro" features) require a paid subscription.

2. No guarantee of accuracy

Fuel prices change frequently and are not always reported instantly. We work hard to keep the data fresh but we cannot guarantee that any price displayed in the Service is the price you'll be charged at the pump. Always confirm the price on the station's pylon or pump before fuelling. We are not liable for any loss arising from out-of-date, incorrect, or missing prices.

3. Your account

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and notify us promptly if you suspect unauthorised use. You're responsible for activity on your account.

4. Acceptable use

• Don't submit prices you know to be false, or attempt to manipulate the leaderboard or rankings.
• Don't scrape, reverse-engineer, or build a competing product from our data.
• Don't use the Service to violate any law or another person's rights.
• Don't interfere with the Service's operation or security.

We may suspend or terminate accounts that breach these rules.

5. User-submitted content

When you submit a price report, comment, or any other content to the Service, you grant us a worldwide, royalty-free licence to use, display, and distribute that content as part of operating the Service. You confirm you have the right to submit it. We may remove content that is misleading, abusive, or breaches these Terms.

6. Subscriptions and payments

FuelSense Pro is offered on a monthly, yearly, or lifetime basis. Payments are processed by Apple via the App Store, and Apple's terms apply to that transaction. Subscription pricing displayed at the time of purchase is binding for that billing period.

• Free trial. A 7-day free trial is available to new Pro subscribers. The trial converts to a paid subscription unless cancelled at least 24 hours before it ends, via your Apple ID subscription settings.
• Renewals. Monthly and yearly plans renew automatically until cancelled.
• Cancellation. You can cancel any time through Apple ID subscription settings. Cancellation stops the next renewal; it does not refund the current period (except where required by law).
• Refunds. Refund requests for App Store purchases must be made through Apple. We don't process refunds directly.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law or other laws that cannot be excluded. To the extent permitted by law, our liability for breach of any non-excludable consumer guarantee is limited to re-supplying the Service or paying the cost of having it re-supplied.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service. Our total aggregate liability in any 12-month period is limited to the amount you paid us for the Service in that period (or A$50, whichever is greater).

9. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Service you also accept the Privacy Policy.

10. Changes to the Service or these Terms

We may update the Service or these Terms from time to time. If we make a material change to these Terms, we'll let you know in the app or by email. Continued use after the change means you accept the updated Terms.

11. Termination

You can stop using the Service at any time and delete your account from within the app. We may suspend or terminate access if you breach these Terms or if we cease offering the Service.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
